CEG Group Consolidated Privacy Policy

CEG Group entities

“CEG Group” is a descriptive collective term and is not itself a separate registered company, juristic person or private body.

Each company listed below is a separate legal entity and remains individually responsible for its own statutory and regulatory obligations.

Financial services

CEG Financial Services (Pty) Ltd is an Authorised Financial Services Provider, FSP No. 50392.

CEG Wealth Management (Pty) Ltd is a separate Authorised Financial Services Provider, FSP No. 55516.

Each authorisation belongs to the legal entity to which it was issued. No other CEG Group company should be represented as operating under either FSP licence unless legally entitled to do so.

Accounting, tax, corporate advisory, fiduciary, company-secretarial, management and other services provided elsewhere within the CEG Group should not automatically be characterised as financial services under FAIS merely because they are provided within the broader group.

Applicable framework

Depending on the relevant legal entity and the activity being undertaken, CEG Group entities may be subject to South African legislation and regulatory requirements including:

  • Promotion of Access to Information Act 2 of 2000 (PAIA);
  • Protection of Personal Information Act 4 of 2013 (POPIA) and applicable Regulations;
  • Financial Advisory and Intermediary Services Act 37 of 2002 (FAIS) and applicable Codes of Conduct;
  • Financial Sector Regulation Act 9 of 2017;
  • Financial Intelligence Centre Act 38 of 2001 (FICA);
  • Companies Act 71 of 2008;
  • Electronic Communications and Transactions Act 25 of 2002;
  • Consumer Protection Act 68 of 2008;
  • Collective Investment Schemes Control Act 45 of 2002 where applicable;
  • tax, employment and other legislation applicable to the relevant entity and activity.

Access to information

The CEG Group Consolidated PAIA Manual has been prepared in terms of section 51 of PAIA for the group entities identified in the Manual.

A request for access to a record of a CEG Group entity must be directed to the Information Officer of the legal entity that holds or controls the record and must comply with the prescribed PAIA process.

Requests are made using the prescribed Form 2: Request for Access to Record.

The prescribed request fee for a private body is currently R140, subject to applicable exemptions and any future amendment of the PAIA Regulations. Access, reproduction, search, preparation and other applicable fees are charged in accordance with the current statutory fee schedule.

Personal requests for a requester’s own records may be subject to different fee rules.

PAIA complaints and remedies

There is no internal PAIA appeal against a decision of the head or Information Officer of a private body.

A requester or third party who is dissatisfied with a decision or non-response may use the remedies available under PAIA, including lodging a complaint with the Information Regulator using PAIA Form 5 and, where applicable, seeking relief from a court.

Protection of personal information

Each CEG Group entity is responsible for complying with POPIA in relation to personal information for which that entity is the responsible party.

The CEG Group Consolidated Privacy Policy explains the categories of information processed, purposes of processing, security safeguards, data-subject rights, sharing arrangements, cross-border processing and Information Officer details.

FICA and client verification

Where a CEG Group entity is an accountable institution or is otherwise subject to the Financial Intelligence Centre Act, it must comply with the customer-due- diligence, record-keeping, reporting and other obligations applicable to that entity and activity.

Clients may therefore be required to provide identity, beneficial-ownership, source-of-funds or other verification information before or during an engagement where required by law.

Conflicts of interest

Authorised financial services providers within the CEG Group maintain conflict-of-interest arrangements and policies as required by applicable FAIS requirements and Codes of Conduct.

Actual or potential conflicts relating to a regulated financial service are managed and disclosed in accordance with the requirements applicable to the relevant FSP.

Copies of applicable policies may be requested from the relevant entity.

Complaints relating to a CEG Group entity should first be submitted to that entity so that the matter can be investigated and, where possible, resolved.

Where a complaint falls within the jurisdiction of the Office of the Ombud for Financial Services Providers, the complainant may refer the matter to the FAIS Ombud after following the applicable internal complaints process.
